Ciarb has successfully retained its contract as the sole provider of Arbitration Referral Services to the Pubs Code Adjudicator (PCA).
Following a two-year partnership, Ciarb has successfully retained its contract as the sole provider of Arbitration Referral Services to the PCA for a further year.
Since becoming the sole provider in December 2021, Ciarb has administered the PCA’s arbitration service. Ciarb will also continue to recommend arbitrators to the PCA thereby supporting the PCA’s regulatory obligations.
Our Pubs Code Panel features the following arbitrators, all fully trained on the Pubs Code:
Catherine Dixon MCIArb, CEO of Ciarb, says, “We are pleased that our high-quality Arbitration Referral Service is performing so well for the Pubs Code Adjudicator (PCA) and are delighted that they have asked us to extend our term for a further year. As well as providing the PCA with the administration of the arbitration service, we also provided Pubs Code Training and assessment for arbitrators on a dedicated panel. We look forward to continuing to work with the PCA team and our Pubs Code Arbitrators in 2024.”
Fiona Dickie, PCA says, “Over the last two years the Ciarb has worked to ensure that arbitration referrals have been managed effectively. I am pleased this contract has been extended. An efficient dispute referral service benefits tied tenants in the exercise of their Pubs Code rights. I will continue to work closely with Ciarb and to receive arbitration documents in line with the arbitrator standards, so that I can keep a close watch for non-compliance by the regulated pub companies and give further clarity to the industry on applying the Code.”
The Pubs Code came into effect in 2016 and regulates the relationship between all pub companies owning 500 or more tied pubs in England and Wales and their tied tenants. The PCA is responsible for enforcing the Code and providing an arbitration service for disputes between pub companies and tied tenants about Code compliance. The PCA can either arbitrate the dispute or appoint another arbitrator to do so.
Referrals for arbitration made under the Pubs Code should be sent by email to the Ciarb Dispute Appointment Service (DAS) team at pca@ciarb.org.
