Ongoing Learning Series – A Deep Dive into the CIArb Professional Practice Guidelines: Best Practices in International Commercial Arbitration

Take a closer look at CIArb’s Professional Practice Guidelines on International Commercial Arbitration in a series of sessions with experienced practitioners.  Join our panel as they examine how the CIArb Guidelines can assist in addressing these commonly confronted challenges and share tips from their extensive experience as arbitration practitioners.

CIArb Guidelines: Session 1_Pre-Hearing Practicalities

In the first session, our panel of experts will explore pre-hearing issues that every arbitrator, party, and their counsel confront in an arbitration, including setting terms of appointment and remuneration for an arbitrator, conducting pre-appointment interviews with tribunal candidates, and organising the procedural and administrative aspects of upcoming arbitrations.  This session will introduce attendees to the relevant CIArb Guidelines and provide practical tools for addressing these common issues. 

The relevant guidelines are 1 (Managing Arbitrator Interviews), 2 (Terms of Appointment including Remuneration), and 6 (Managing Arbitrations and Procedural Orders).

CIArb Guidelines: Session 2_Procedural Possibilities

In the second of CIArb’s series on our Professional Practice Guidelines (PPGs) for International Commercial Arbitration we explore a few of the procedural tools which parties can potentially utilise after the appointment of a tribunal and before an award is issued. Challenges to a tribunal’s jurisdiction and applications for interim measures, including security for costs, are procedural options available to parties which can have significant impacts on an arbitration. This session will examine these procedural mechanisms from the viewpoints of the parties that raise them and the arbitrators who evaluate them.  This session will introduce attendees to the relevant CIArb PPGs and provide practical tips for handling these procedural options. Join our panel of experts as they explore strategies for making and assessing these applications and share tips from their extensive experience as practitioners.

The relevant guidelines are 3 (Jurisdictional Challenges), 4 (Applications for Interim Measures), and 5 (Security for Costs).

CIArb Guidelines: Session 3_The Power and Purpose of the Process

In the last of CIArb’s series on our Professional Practice Guidelines (PPGs) for International Commercial Arbitration we explore making effective awards in arbitration.  In this session we will go beyond the formal requirements of an enforceable award and look to what arbitrators consider when deciding disputes and how they move from the parties’ presentations of evidence to weighing the issues and drafting powerful awards.  We will examine what skills arbitrators need to employ to transform their decisions into an effective award and how they handle the complex technical or numerical aspects of a dispute, including the option of leveraging expert witnesses.  This session will focus on the ultimate purpose of the process of arbitration and how arbitrators create valid, effective, durable awards.  This session will introduce attendees to the relevant CIArb PPGs as a resource for their own award writing. Join our panel of experts as they share insights from their extensive experience as arbitrators.

The relevant guidelines are 7 (Party Appointed and Tribunal Appointed Expert Witnesses), 10 (Drafting Arbitral Awards Part I - General), 11 (Drafting Arbitral Awards Part II - Interest), and 12 (Drafting Arbitral Awards Part III – Costs).
