Singapore Convention: CIArb submit response to Ministry of Justice consultation

On the 2nd February 2022, the UK Government issued a consultation call out regarding The Singapore Mediation Convention and whether the UK should become a signatory to it. The Convention is an important vehicle for promoting the wider use of mediation and the UK can be a valuable partner in driving this agenda forward.

A variety of questions were put forward in the consultation, including whether it is the right time for the UK to join; what impact we think becoming Party to the Convention would have for UK mediation and mediators; and, whether the UK government would consider making a reservation under Article 8 should the UK choose to ratify.

As noted in the CIArb submission, we believe is the right time for the UK to become a party to the Convention. With Britain continuing to grow and develop its role as a global influencer in a post-Brexit world, the UK should become not only a party, but it should also position itself as an active proponent of international commercial mediation.

CIArb foresee that there will only be a positive impact on the UK becoming party to the Convention. Specifically, there will be a positive impact on parties who are more likely to adopt mediation as an alternative route from traditional litigation or indeed, as part of the litigation process.

The Government are currently analysing public feedback on this consultation and will publish more information on this later in the year.
