Ciarb Global Survey on Expert Witness Evidence
We are seeking responses from the ADR community in our global survey.
Expert evidence is usually relevant (sometimes determinative) in international arbitration, and we are on a perpetual search as to how to help a tribunal understand the evidence better. The responsibility does not solely rest with the expert witnesses – it is the users of arbitration (i.e. the parties, their legal representatives, and the tribunal) who share that responsibility.
The Ciarb 2025 Global Survey on Maximising the Effectiveness of Party-Appointed Expert Witness Evidence in ADR is an open invitation for any member of the ADR community to please share your thoughts and experiences on the subjects of:
- communication between experts, the tribunal, and counsel;
- timetables and timing of involvement of experts;
- ensuring the tribunal understands the expert input; and
- the hearing and post-hearing process.
We are therefore seeking responses from all of our members to our global survey. This will help us develop any resources or training to better support our members to maximise the effectiveness of expert witness evidence in ADR.
We will also be producing a report on the findings of the survey, which we will share with our members in the summer.
