The ADR knowledge I have here is facilitative mediation. Being a project management role in a construction project, I have adopted mediation skills in my daily work experience of solving problems and managing conflicts between the client and the main contractor or other parties. For example in my current ongoing project, the Main Contractor(MC) is responsible for rectifying all defect items during the defect liability period (warranty period), however, the method that the MC would choose may be the cheapest way to cover the problems but not to solve while it is believed that this would be the MC's underlying interest. And in the Client's point of view, they may want to put some wear and tear issues and treat them as defects taking MC's advantage. By this opportunity, we, as a consultant role of this project, are trying to guide both of them to think about the BATNA and WATNA during the meeting or in some time it is more likely a negotiation table so the solution which makes everyone accepted and happy can be easily figured out and in the same time, they can keep the good relationship and work together in the future.
