Marc R Labgold, PhD, JD is an independent international arbitrator who also serves as arbitration counsel as well as being a registered patent attorney and patent litigator. He regularly serves as lead counsel in complex international commercial arbitrations under a broad range of arbitral rules and procedures (e.g., ICC, UNCITRAL, HKIAC, FAA, ad hoc), in disputes arising from a wide array of contract types including, inter alia, OEM agreements, EPC contracts, industrial construction contracts, distribution agreements, license agreements, joint development agreements, research agreements. As counsel, he has led the successful defense against numerous jurisdictional challenges (including binding non-signatories) and have achieved awards as high as US$475,000,000. He as expertise and experience in disputes involving patents, misappropriation of trade secrets, trademarks and copyrights, both as counsel and as an arbitrator.
Dr Labgold is an accomplished trial attorney with extensive international experience in complex litigation involving patent infringement, theft of trade secrets, unfair competition and breach of contract. He has handled more than 60 patent cases, including both bench and jury trials in Federal District Courts throughout the United States, appeals before the Court of Appeals for the Federal Circuit, Second Circuit, Ninth Circuit, and Supreme Court of the United States. He also is expereienced in practice before the U.S. International Trade Commission.
He is a panelist on the AIAC Panel of Arbitrators, THAC Panel of Arbitrators, ICDR Panel of Arbitrators, the WIPO List of Neutrals and the AIPLA List of Arbitrators and Mediators. He is a Member (MCIArb) of the Chartered Institute of Arbitrators, a Fellow (FBiam) of the Bali International Arbitration and Mediation Center and a Fellow (FPD) of Prime Dispute.
Dr Labgold regularly lectures on issues pertaining to international commercial arbitration and is an Adjunct Professor of Law at Florida International University College of Law and a Coach of the FIU Law team for the Willem C. Vis Moot.
