Mr. Phuc (Jason) is the Arbitral Assistant of ADR Vietnam Chambers LLC. Mr. Phuc is accredited as a Member of the Chartered Institute of Arbitrators (MCIArb). At the same time, Mr. Phuc is lecturer of Faculty of Social Sciences - Law, Hoa Sen University, Ho Chi Minh City, Vietnam.
Prior to joining ADR Vietnam Chambers in his current role, Mr. Phuc worked at EPLegal in Ho Chi Minh City, Vietnam. EPLegal is a leading law firm with full services, especially Energy and Dispute settlement resolution in Vietnam. Currently, EPLegal has offices in Vietnam and the United Kingdom (Birmingham).
Phuc's expertise extends to academic research in international arbitration, investor-state dispute settlement (ISDS), and inter-state dispute settlement (WTO's dispute settlement system). As a researcher-practitioner, he was honored as the winner of the prestigious EURÉKA Scientific Research Award XXIII, presented by Vietnam's Ministry of Science and Technology. Furthermore, he was awarded a Dean's recommendation scholarship, enabling him to study international commercial arbitration and sales law in the United Kingdom for nearly two years at University of East Anglia, Norwich city. His dedication paid off as he successfully passed the examination and obtained recognition as a Member of the Chartered Institute of Arbitrators (CIArb).
At EPLegal, Jason has valuable opportunities to expand his expertise in the Dispute Resolution - Arbitration & Litigation sectors. He has actively participated in a range of significant cases, including:
- Advising and representing a Vietnamese State-own Company in a dispute settlement with a global power engineering company regarding the performance of the EPC Contract at the Singapore International Arbitration Centre (“SIAC”). This is one of the highest-valued SIAC arbitration on construction disputes so far.
- Advising an India Company in a dispute settlement with a Vietnamese company arising out of the performance of the EPC Contract regarding a hydropower project in Vietnam at the Vietnam International Arbitration Centre ("VIAC").
- Advising and representing a Vietnamese company in a dispute against an oil and gas company over a cooperative contract for implementing the apartments and shopping mall project, value of the dispute over VND 100 billion.
- Advising a Vietnamese company in resisting the recognition and enforcement of an ICC Swiss arbitral award in Vietnam.
In addition to his dispute resolution expertise, Jason has also participated in licensing cases related to offshore investment applications. Furthermore, he has received training in contract schemes for the oil and gas industry, particularly in Production Sharing contracts, Crude oil, Gas, and LNG sale and purchase agreements.
