The construction industry in the MENA region has for decades been witnessing a significant trend: the imposition of major amendments to FIDIC contracts. These major amendments invariably disturb the balanced risk allocation in the FIDIC contracts by shifting obligations disproportionately between the contracting parties, eventually leading to the propagation of claims and disputes. This trend resulted, among other reasons, in FIDIC's issuance of the Golden Principles in 2019.
