UNCITRAL Working Group III at a Crossroads

 

Over the last few years, the criticisms by states of the investor state dispute resolution system (ISDS) have gotten considerable attention.  As a result of these issues raised, UNCITRAL dedicated Working Group III specifically to address ISDS Reform tools and options. But what states are actually able to do and what states have done over the 6 years remains shrouded in mystery for many in the arbitration world.  Additionally, since WG III was formed significant concerns have been raised by investors as well. While the mandate of WG III was limited to 'procedural issues' the line has been blurred as many of the proposed reform tools cross into substantive territory traditionally reserved to arbitrators. Many questions remain, such as:  Is the UNCITRAL process fair to investors? What is the scope of the actions states can take?  Do the criticisms on which states based the establishment of WG III hold weight? What reform tools have been produced and how effective will they be? And what about the much-touted multi-lateral investment court and appellate mechanisms options which have yet to be fully explored? And what about other issues of concern, such as damages amounts and third-party funding?

Join us to discuss these questions and more with those who participate and observe the work of WG III in person and provide your own views on ISDS reform.

Mercy McBrayer FCIArb is Ciarb’s Head of Arbitration Professional Practice. Mercy is a United States qualified attorney (Texas) and certified mediator with experience as party counsel in commercial business litigation and arbitration. She is an assistant editor of the Ciarb Journal, a Teaching Fellow in international arbitration at Queen Mary University of London, a speaker and lecturer on issues of international arbitration and ADR, and moot coach.
