There are many reasons why expert witness evidence may be viewed by decision makers as incomplete or unhelpful. A common response is to see this as the fault of the expert witnesses. Moderators and participants will explore whether or not that is the case and discuss potential solutions. 

Moderated by Michael Tonkin FCIArb C.Arb and Pamela McDonald, joined by counsel, arbitrators and expert witnesses as moderators, this Let’s Discuss event is a platform to discuss and learn from each other on what works and what does not work in the management of expert witnesses, the production of reports, joint processes, oral evidence and other duties of the expert witnesses in ADR, particularly in arbitration and adjudication.

Michael Tonkin C.Arb FCIArb

Michael Tonkin BSc DipArb DipICIArb FRICS FCIArb FCIOB FDBF MAE C.Arb is a Chartered Quantity Surveyor, Chartered Arbitrator, Chartered Builder, CEDR Accredited Mediator, RICS Accredited Expert Witness and testifying Expert Witness in quantum with 35 years of experience in the construction industry. He leads HKA’s Expert Services practice for the Middle East, Asia & Africa.

He acts as an expert witness in quantum and has been instructed around sixty-five times as a party appointed Expert Witness, a single joint Expert Witness and a Third Party Expert Evaluator on disputes up to US$4bn in value. He has given oral testimony in traditional cross-examination as well as concurrent evidence/hot-tubbing. Michael has acted as “Coordinating Expert” across several disciplines of expert. He is a Who’s Who Legal (WWL) Global Elite Thought Leader and has published various material on the role of the expert witness.

Michael has been appointed as Arbitrator on more than 60 occasions (as sole Arbitrator, Chairman of a tribunal of three, and Co-Arbitrator) under the auspices of ICC, LCIA, DIAC, ADCCAC and the TAI, and is a listed panel member form many institutions, including the Ciarb.

He also acts as dispute resolver in other ADR such as adjudication and DAB’s and is a member of the DRBF.

Michael is a former Ciarb Trustee, Honorary Treasurer and Chair of the Audit Committee, as well as a past Chairman and past Vice Chairman of the UAE Branch. Michael is an “Arbitrator” Member of the Society of Construction Arbitrators.

Pamela McDonald

Pamela is a Partner, head of the Doha office and global co-head of International Arbitration at Pinsent Masons. Pamela is an active member of the Ciarb, a board member of the National Association of Women in Construction and a co-head of the Campaign for Greener Arbitration’s MENA Chapter. Pamela relocated from London to Qatar in 2014 and advises clients on complex infrastructure and energy projects in the Middle East during project execution phase, and in formal litigation and arbitration proceedings. 

Franco Mastrandrea

Lucy Greenwood

Lucy Greenwood is an independent arbitrator specializing in international commercial and investment disputes. She has practised international arbitration since 1998 (in London, Paris and Houston) and has acted as arbitrator in more than 90 arbitrations since becoming a full time arbitrator in 2017. She is highly regarded for her prompt, efficient resolution of disputes and active case management of arbitrations and is particularly in demand as a chair for major energy disputes. She is ranked Band 1 by Chambers, as a Global Elite Thought Leader by Who’s Who Arbitration and was shortlisted by Legal 500 for Arbitrator of the Year in 2023.  Lucy is a Chartered Arbitrator, a Texas attorney and a Solicitor of the Senior Courts of England and Wales. She is a Trustee of the Chartered Institute of Arbitrators, Past Chair, International Committee, Dispute Resolution Section, American Bar Association, Past Chair, North America Branch of the Chartered Institute of Arbitrators and is a Fellow of the College of Commercial Arbitrators.  She is the founder of the Campaign for Greener Arbitrations, an initiative to reduce the environmental impact of international arbitrations.
