Virtual Module 1 Law Practice and Procedure of International Arbitration 2022

On successful completion of this course and the accompanying assessment, you will achieve important learning outcomes including being able to:

• Define what is meant by the term ‘International’ Arbitration.
• Identify, explain and apply the legal procedural principles, rules and agreements relevant to the conduct of an International Arbitration.
• Learn the legal framework, including limitations of matters that may be legally arbitrated.

You will also become very familiar with the:

• Contractual nature of the appointment of an Arbitrator.
• Range and limitations of an Arbitrator’s powers and jurisdiction.
• Rights, duties and responsibilities of a party to an Arbitration.
• Methods of initiating and processing an Arbitration.
• Relevance of the court regarding all stages in an Arbitration.
• Requirements of an enforceable Award.

You will also be able to evaluate and apply:

• Principles and legal requirements of an International Arbitration.
• Principles of the UNCITRAL Model Law as well as a regional Arbitration law, appropriately.

And demonstrate skills in: -

• Carrying out the tasks required in preparing for and progressing an International Arbitration.
• Controlling an International Arbitration, communicating effectively with the parties, applying the UNCITRAL Arbitration Rules and adopting appropriate procedures.

How is the course delivered?

This course starts on 15 September and is delivered over a period of three months.

The three months consists of 4/5-week private study periods, each followed by 2 half day virtual
tutorial sessions (a total of 6 half days across the course).

What is my next step when I complete the course?

Once you have successfully completed this course and the accompanying assessment, you are eligible to:

• Apply to become a Member of CIArb which entitles you to display the globally recognised and respected MCIArb letters after your name. The MCIArb signifies to clients, colleagues and regulators that you have demonstrated an outstanding commitment to achieving the highest level of knowledge, skills and behaviour in ADR.
• Progress onto Module 2 of the International Arbitration pathway:
  • Module 2: Law of Obligations
• Apply for the Module 2 Exemption Test. If you have passed any Module 1 course, have a Law Degree or can demonstrate the necessary knowledge via your CV you will be exempt from taking the Module 2: Law of Obligations course and the accompanying assessment. So, you will be able to move straight onto Virtual Module 3: Award Writing in International Arbitration 2021.
