How is the course delivered?

This course starts on 31 March and is delivered over a period of three months.

The three months consists of 4/5-week private study periods, each followed by 2 half day virtual tutorial sessions (a total of 6 half days across the course).

On successful completion of this course and the accompanying assessment, you will achieve important learning outcomes including being able to: -

  • Explain, evaluate and apply the principles and specific requirements in a Construction Adjudication.
  • Compare and contrast Construction Adjudication legislation and practice in different jurisdictions.
  • Understand the rights, duties and responsibilities of each of those involved in an Adjudication.
  • Identify, explain and apply the legal procedural principles and rules relevant to the conduct of a Construction Adjudication.
  • Recognise the requirements of an enforceable Adjudication decision.

You will also become very familiar with the: -

  • Range and limitations of matters that may legally be adjudicated
  • Contractual nature of the appointment of an Adjudicator
  • Range and limitations of an Adjudicator’s powers and jurisdiction
  • Rights, duties and responsibilities of each of those involved in an Adjudication
  • Methods of initiating and processing an Adjudication
  • Relevance of the court regarding all stages in an Adjudication
  • Requirements of an enforceable Adjudication decision

You will also be able to demonstrate practical skills in:-

  • Carrying out the tasks required in preparing and progressing an Adjudication.
  • Controlling Adjudication, communicating effectively with the parties, applying the relevant rules and adopting appropriate procedures.

How will I be assessed?

This course is completed via LearnADR, CIArb's online learning platform.

You will be given 48 hours within a 5-day window to submit your answers online.

You must achieve a minimum overall mark of 65% to pass the assessment.

What is my next step when I complete the course?

Once you have successfully completed this course and the accompanying assessment, you are eligible to:

  • Apply to become a Member of CIArb which entitles you to display the globally recognised and respected MCIArb letters after your name. The MCIArb signifies to clients, colleagues and regulators that you have demonstrated an outstanding commitment to achieving the highest level of knowledge, skills and behaviour in ADR.
  • Progress onto Module 2 of the International Arbitration pathway:-
    Module 2: Law of Obligations
  • Apply for the Module 2 Exemption Test. If you have passed any Module 1 course, have a Law Degree or can demonstrate the necessary knowledge via your CV you will be exempt from taking the Module 2: Law of Obligations course and the accompanying assessment. So, you will be able to move straight onto Module 3: Decision Writing in Construction Adjudication.
