Why is there a need for this course?
There has always been a need for good negotiation training as the skills required feed into so much of what professionals do, particularly in the field of conflict avoidance and dispute resolution. With the pandemic inflicting such economic chaos on the country there is much more focus on collaborative working, as trying to protect companies’ and peoples’ rights is simply not working as it was supposed to under the protection and enforcement of contracts. We have all seen stresses leading to insolvency or at least a temporary inability to pay. That emasculates court action, since the court has no power to rewrite contracts. The answer is flexible negotiation, if necessary managed by third party neutrals, but certainly by specialists. This is particularly true of property, landlord and tenant, insurance, and supply chain problems, which have all been badly affected and which would benefit from flexibility being built into relationships.
Can you tell us about the course? /what are the key components of the course?
The course is built around exercises which are designed to help participants understand what techniques work and what does not work in negotiation, and, as important, why. Together with an element of online classroom learning, participants will come to contextualise and appreciate their own strengths and weaknesses and look for opportunities to improve their position. Breakout rooms will be used for small group discussions and role play. Those wishing to follow up the learning outcomes will be provided with a more extensive reading list.
What are the benefits of this course for course takers?
Participants in the course will be able to take their learning straight into use in their home professions or occupations. It will not only provide them with a range of techniques but give them confidence to try approaches they may not have considered before. The Chartered Institute of Arbitrators (CIArb) has launched its ‘Negotiation Skills for the Pandemic and Beyond 2021’ course. This virtual programme is a highly sought-after skills-based course that will cover the fundamentals of negotiation within the context of emerging issues arising from the pandemic. The course will also include: an introduction to negotiation, its language and characteristics, the principal strategies and techniques involved, and their preparation and management in transactional business and contentious professional practice, for lawyers and others.
This is a 2-day virtual course totalling 9.5 -10 hours suitable for various time zones: Europe, Africa, India and South East Asia. PowerPoint will be used and there will be a variety of pre-reading materials and activities during the programme. The tutor will deliver the course in CIArb’s dedicated virtual classroom. Case studies/exercises built around topics deriving from pandemic-related problems will be used and for group discussions, virtual table discussions, individual exercises, group exercises, role plays, game theory exercises and a deconstruction of results.
