In memoriam: Stephen O’Rourke QC, FCIArb

The Scottish Branch of the Chartered Institute of Arbitrators is deeply saddened to announce the untimely death of Stephen O’Rourke QC.  Not only was Stephen a Fellow of the Institute but he has been a Committee member for a number of years and up until recently was the Education Convenor for the Branch.

Torquil Murray, Chair of the Scottish Branch said “Since becoming involved with the CIArb, Stephen gave freely of his time to the Scottish Branch through his role in developing branch education, undertaking lectures and promoting ADR in general. Committee are all devastated on hearing the news. Stephen was a down to earth, entertaining and amiable colleague. He will be sadly missed by committee and the Branch in general. His input will be greatly missed. Our deepest condolences go out to his family and those close to him.

Joint intervention success as Churchill judgment allows the courts to order parties to mediate

In a significant moment for mediation, the highly anticipated Churchill judgment overturns the decision in Halsey, confirming it is not a breach of human rights to integrate mediation into the court process and, where appropriate, to order parties to mediate. CMC, Ciarb and CEDR joined forces to intervene in the case, arguing strongly for this outcome.
