CIArb's next Branch to be launched in Brazil

CIArb is thrilled to announce that its forty-first branch will be launched in São Paulo, Brazil on 23 October 2019. The launch event will be preceded by a conference and ceremony of granting of the CIArb Brazil Branch Patron Title to Roberto Azevêdo, Director-General of the World Trade Organization (WTO) taking place on 27 September 2019.

Brazil is one of the most pro-arbitration jurisdictions in the world. International arbitration has made considerable advances in this country in the past few years, the number of cases has increased and Brazilian courts have become consistently supportive of arbitration. These factors make Brazil a natural choice for CIArb to establish its presence in this region to drive its mission of promoting ADR on a global scale.

"Dispute Resolution and Promotion of International Trade" conference and the ceremony of granting of the CIArb Brazil Branch Patron Title to Roberto Azevêdo (Director-General of WTO ) will be held on 27 September 2019 in São Paulo. Conference speakers will include Roberto Azevêdo, Cristina Mastrobuono FCIArb, André Chateaubriand, Antonio Carlos Monteiro da Silva FCIArb with the presence and participation of Joanna Crellin, HMTC & British Consul-General in São Paulo and Cesar Pereira FCIArb, President of CIArb Brazil Branch. The speakers will discuss how alternative dispute resolution methods are essential for the development of international trade.

The Launch of CIArb Brazil Branch will take place on 23 October 2019 in São Paulo. The event, entitled “CIArb and current issues in International Arbitration” will consist of presentations on the following topics:

Ethics in International Arbitration, by Ann Ryan Robertson FCIArb
CIArb Protocols and the Taking of Evidence, by Jeffrey Elkinson C. Arb FCIArb
Cybersecurity and Digital Transformation in Arbitration, by Brandon Malone FCIArb

The lectures will be followed by a discussion including comments from Frederico Singarajah FCIArb, Andrea Galhardo Palma FCIArb, Joaquim Muniz FCIArb and Eugenia Marolla ACIArb. The panel discussion will be moderated by Napoleão Casado Filho FCIArb and Vice-Chair of the CIArb Brazil Branch and hosted by Júlio César Bueno FCIArb.

Joint intervention success as Churchill judgment allows the courts to order parties to mediate

In a significant moment for mediation, the highly anticipated Churchill judgment overturns the decision in Halsey, confirming it is not a breach of human rights to integrate mediation into the court process and, where appropriate, to order parties to mediate. CMC, Ciarb and CEDR joined forces to intervene in the case, arguing strongly for this outcome.
