National court systems globally have become convinced that mediation is crucial to high-quality, just, cost-efficient, negotiated outcomes, that do not need enforcement because they have been mutual agreed, rather than imposed. 

However, the simple and painful truth is that getting parties to engage in mediation is almost always a huge challenge, despite mediation’s benefits and its lack of downsides.  

As a result, governments, legislatures, and courts have introduced structures to push reluctant disputants into mediation. The administrative requirements, structures, processes, level of compulsion and type of mediation across these systems vary and yet tend now to simply be labelled as ‘mandatory mediation’.  

This webinar will draw on the expertise of those directly involved in contrasting jurisdictions and draw out lessons learned in relation to: 

• Structures of court-connected mediation programmes internationally 
• Types and levels of compulsion to mediate; and resulting legal questions
