Join the Chartered Institute of Arbitrators Ireland Branch in the spectacular surroundings of the Irish Architectural Archive in Dublin, to hear these expert panels discuss two papers.
The first paper is titled ‘Adjudication – the only game in town’ that will discuss the last five years of Adjudication under the Irish ‘Construction Contracts Act 2013,’ based upon a peer reviewed academic paper recently published in Arbitration, Volume 89, Issue 2, 2023. The paper delivered by Dan Daye MCIArb MRIAI, who is the Chair of the RIAI ADR Task Force, will examine the Act in the context of recent Irish case law, with a focus on the operation of adjudication. The lecture will also discuss the efficacy of the Act in its primary policy objectives of, firstly, providing a prompt payment regime to improve recognised issues with cash flow and, secondly, the introduction of a process for the swift resolution of payment disputes.
The second paper titled ‘Construction adjudicator fees – Are they unreasonable?’ will review the fees charged by adjudicators following concerns expressed at the ‘Construction Contract Act 2013 – 7 Years on’ conference held previously on 5th July. This second paper, delivered by Peter O’Malley FCIArb MRIAI RIBA will seek to investigate if the asserted concern over high levels of fees charged is well founded, or not, based upon an interrogation of available data, other comparisons, and whether fees can be reasonably anticipated at the outset.
These two papers, which will be of particular interest to all those with an interest in adjudication under the Construction Contract Act 2013, will be followed by a discussion panel where the presenters will be joined by Niav O’Higgins and Keith Kelliher FCIArb to continue debate on points raised within the papers.
They will conclude at 7.30pm, or shortly after, and will be followed by light refreshments and further discussion.
