In this two part series, David Fearon FCIArb will explore the subject of termination of construction contracts. In part 1, he will look at when (and when not) the right might be exercised under a contract expressly providing for such termination. He will consider what events usually give rise to the right to terminate. How the right is properly exercised. The consequences if termination is either unjustified, or the right is not properly exercised in form or substance. How delay, or approbation, might affect the right. What is the distinction between terminating ‘the contract’ and ‘terminating the contractor’s employment under the contract? And is there a difference in practice?
This talk will remind and stimulate the experienced practitioner as much as the student in an area of law where mistakes can be fatal to a case.
There will be an opportunity for questions to be submitted using the ‘chat’ facility during the webinar. Time will count towards education hours.
