In the last of CIArb’s series on our Professional Practice Guidelines (PPGs) for International Commercial Arbitration we explore making effective awards in arbitration. In this session we will go beyond the formal requirements of an enforceable award and look to what arbitrators consider when deciding disputes and how they move from the parties’ presentations of evidence to weighing the issues and drafting powerful awards. We will examine what skills arbitrators need to employ to transform their decisions into an effective award and how they handle the complex technical or numerical aspects of a dispute, including the option of leveraging expert witnesses. This session will focus on the ultimate purpose of the process of arbitration and how arbitrators create valid, effective, durable awards. This session will introduce attendees to the relevant CIArb PPGs as a resource for their own award writing. Join our panel of experts as they share insights from their extensive experience as arbitrators.

Event Speakers
Mercy McBrayer, FCIArb, is CIArb’s Head of Arbitration Professional Practice. Mercy is a United States qualified attorney (Texas) and certified mediator with experience as party counsel in commercial business litigation and arbitration. She holds a Master of Laws (LLM) in comparative and international dispute resolution from Queen Mary University of London, a Juris Doctorate (JD) from Southern Methodist University, and a Master of Science (MSc) in environmental biology from the University of North Texas. Mercy is also a graduate of CIArb’s Post-Graduate Diploma programme in international commercial arbitration (PGDip). Mercy trained in international commercial arbitration with Al Tamimi and Co. in Dubai, UAE, and was an associate with Blume, Faulkner, and Skeen in Dallas, Texas, before joining the CIArb Executive in 2018. Mercy is CIArb’s observer delegate to UNCITRAL Working Groups II and III and curator of CIArb’s professional practice guidelines. She is an assistant editor of the CIArb Journal, a Teaching Fellow in international arbitration at Queen Mary University of London, a speaker and lecturer on issues of international arbitration and ADR, and moot coach. Mercy is a US citizen who grew up in Nairobi, Kenya and is based in London, UK.
Shan Greer is an independent arbitrator, mediator, and lawyer based on the island of Saint Lucia in the Caribbean. She has over twenty years of experience advising clients on a wide variety of commercial transactions and disputes with specific expertise in construction law. Shan Greer regularly acts as an arbitrator, adjudicator and mediator in ad hoc, institutional, international and domestic arbitrations in both civil and common law jurisdictions. Shan Greer is passionate about education. She not only co-founded the Caribbean ADR Initiative, a nonprofit promoting the use of ADR in the Caribbean, but is a past Chair and current Education Director for the Chartered Institute of Arbitrators, Caribbean Branch. Both these roles have afforded her the opportunity to share her expertise and experience with other Caribbean professionals with the view to building capacity in the region.
Jackie is the Managing Partner at Umsizi LLP, and has considerable experience in a broad range of corporate, commercial and family matters from her more than 20 years practice in various sectors.
A Chartered Arbitrator, she is a Fellow of the Chartered Institute of Arbitrators and a Certified and Court-Accredited Mediator. Jackie serves as Non-Executive Director on various Boards, notably as chairperson of the Nairobi Centre for International Arbitration (NCIA). She has played a critical role in the development of a National Policy on ADR in Kenya, and is a regular speaker in the areas of arbitration, mediation and corporate governance.
Jackie has served as a third-party neutral in a number of domestic and international commercial disputes, and is recognised in the Legal 500 Arbitration Power List (Africa) and Leaders in Law (Corporate Law, Kenya) global awards. In addition to teaching various undergraduate courses in ADR, she is a certified tutor with the Chartered Institute of Arbitrators, and a contributing author to the International and Comparative Legal Guide’s annual publication on Litigation and ADR.
Hanif has been advising clients with disputes in the financial markets for over 15 years and more recently acting as a testifying expert witness. He has given evidence in court. Hanif has been elected a Fellow of the Academy of Experts and has qualified to conduct Expert Determination, a confidential ADR process.
Hanif gained experience in structuring, valuing and selling derivatives at some of the world’s largest investment banks including Lazard Brothers, JP Morgan and Credit Agricole Indosuez, having started in investment banking at Barclays de Zoete Wedd in 1988.
He has a first class degree in Physics from Bristol University where he continued to conduct research in theoretical Physics.
Paul is a member of the Board of Trustees and Chairs the Finance Committee for the CIArb. He is also a Regional Pathway’s Leader. He is a past Chairman of the East Asia Branch of the CIArb and ran the branch training courses for a number of years between 2000 and 2018. He regularly tutors on the CIArb courses.
Paul is also a Chartered Quantity Surveyor but changed career to law, joining solicitors’ Denton Wilde Sapte in Hong Kong and subsequently Heller Ehrman before moving to the HK Bar. His practice area is predominantly arbitration and litigation. He also sits as arbitrator on domestic and international cases.
